Pat The … divorce documents. After Erika Jayne appeared in court to break up her marriage to Tom Girardi, Bravo fans were stunned to discover that one of the most powerful marriages in Real Housewives time was not as perfect as they thought.
The Real Housewives of Beverly Hills star revealed in November 2020 that she and her powerhouse attorney had decided to end their relationship in the midst of 21 years marriage. The source told DailyGossip that exclusively “Erika and Tom had an unconventional marriage, spending a lot of time apart.”
Erika is a mother of her adult son Tommy with her ex-husband Thomas Zizzo, met Tom in the mid-90s when waiting in one of his most-loved West Hollywood hot spots, Chasen’s. After a year she decided to provide him with her phone number, and he later called her via his secretary.
“I told her, ‘Tell Mr. Girardi if he wants to take me out on a date, he needs to call me himself and ask me and give me enough time to prepare,'” the Bravo celebrity wrote in her memoir of 2018, Pretty Mess. “You know what men want at their best when they’re successful. They expect you to throw away everything immediately. This isn’t how I work I don’t care which you are.”
Six months after their first date, Erika and the lawyer were engaged. They got married in January of 1999.
“For the first 10 years of our marriage, I was by Tom’s side,” the “XXPEN$IVE” singer said in an episode on February 17 of RHOBH. “I was the very first woman to join a couple of legal entities. Imagine this!”
Because of Tom’s powerful job, he’s only appeared in a handful of episodes on the reality show in the time since Erika became a part of the team in. It is expected that their split will be a major topic during Season 11, which started filming in October of 2020.
“People are always like, ‘Oh, you guys don’t see each other a lot.’ But when we do see each other, it’s 100 percent, full-on attention,” the former Chicago actor said on the episode of February 2017. “This is something that people don’t get. This isn’t a negative thing for the relationship. It actually helps. It’s much better than having someone constantly in your face every day and not even there.”

Erika Broke The Show Off
The Atlanta native announced in a statement made to Us in November of 2020 the fact that she “decided to end” her relationship with Tom “after much consideration.” She also said “This is not something that should be that is easy or a decision to take lightly. I have a deep admiration and love for Tom and also for the years and our lives together. My goal is to go through this process in a respectful manner and with the confidentiality that Tom and I are entitled to. I would like to request that other people give us that same level of privacy.”
They were on different Paths
A source who spoke exclusively to Us on November 20, 2020, that it was common for the couple, now divorced, to travel for “several months” without seeing the other. “They traveled separately. Tom offered Erika an extremely lavish life, and she loved the lifestyle,” the insider said. “Erika has grown in confidence and independence from her time in Real Housewives of Beverly Hills. The exposure it has provided to her career in music has brought Erika an increased audience.”
They don’t have a prenup
Erika said to Andy Cohen in June 2017 that she and Tom have never had a prenuptial contract. “I’m engaged to a strong lawyer. Prenups wouldn’t get in his way,” she said at the time. “So it doesn’t matter whether you had one or you didn’t, it’s gonna be all Tom’s way, I assure you.”

The Fraud Lawsuit
Erika as well as Tom were targeted by a lawsuit in the month of December that claimed they had squandered settlement money that was intended to assist family members of Lion Air Flight 610 victims. In court documents from the federal courts obtained by Us Edelson PC, a class action company Edelson PC claimed that the divorce between the couple was “a sham attempt to fraudulently protect Tom and Erika’s money” and claimed that the couple “are on the verge of financial collapse and locked in a downward spiral of mounting debts and dwindling funds.” Erika and Tom did not respond immediately about the claims.

As per The Los Angeles Times, Erika was summoned to be a witness in the fraud trial in the months of May 2020 and September 2020 — just before filing for divorce in November. Erika was absent during both times, and the hearing was moved to January 2021. However, she’s not yet ready to testify.

Erika Wants Spousal Support
Erika requested spousal assistance by Tom in November of 2020, according to court papers obtained by Us in which she cited “irreconcilable differences” as the reason behind their separation. She also demanded Tom to pay her attorney’s costs and requested that the court stop her husband’s divorce from seeking support for spousal relations from her.

On November 25in 2020 court papers were obtained through Us, Tom requested to stop the court’s ability to award spousal maintenance to Erika. He also requested her to pay his legal costs.

What’s the Truth about Tom’s Finaces
Tom admitted to his court on September of 2020 that he had “maybe a couple thousand” dollars in a bank account. He also said that his portfolio of stocks of millions of dollars was “all gone.”
He added: “At one point I had $100 million to $50 million cash. All of that is gone. I’m out of money.”
He also said that he hasn’t “taken a penny in salary out of the firm for more than two years.”
The judge was in the courtroom on December 20, 2020. from Chicago confiscated Tom’s property following allegations that the couple had withheld $2 million in client funds in the aftermath of the crash of Lion Air Flight 610 crash. Tom did not appear at the contempt trial at the time and instead was summoned to the proceedings.

As per court records that were obtained through Us, Tom was secretly admitted to an “serious illness” in 2020. A lawyer from his firm mentioned the condition in a court hearing held in December in front of the judge, who stated it was because Tom appeared to be “unavailable in recent weeks due to a serious illness that caused him to be hospitalized for which he sought treatment.”
The document stated that Tom “couched everything” related to the fraud investigation in July 2020 as he was required to leave the company because of his hospitalization. He also identified an illness that he was suffering from as the root to this “mistake” of not getting certain families compensated fully.
The Los Angeles Times also revealed that Tom’s attorney thought he should be subjected to a psychological examination. “I’m unsure that he understands either the nature or the gravity of the current situation,” the lawyer said to the judge, stating that the team is worried regarding his mental capacity.
In January 2021 the sister Robert Girardi claimed Tom was suffering from short-term memory loss . He demanded that he be appointed his conservator since Tom has been found to be “not capable of making rational decisions” in relation to his finances.
Edelson claimed that there’s something more to the tale of Tom’s condition. “I’m not an expert in medicine, so I don’t know. What I can say is that it appeared to be very practical,” Edelson told Kate Casey in June 2021. “When we released the evidence we uncovered during our investigation into the kind of things he was attempting to accomplish at the time the Alzheimer’s disease was affecting him, the truth is that he was scheming, it was to shield himself from fraud. The scheming was to try to hold the most possessions he could He was also planning to try and make cases that were in his pipeline for sale to various companies.”

Tom’s Partners Sue
According to court documents released by various media outlets in December of 2020 Tom’s business partners Robert Keese, Robert Finnerty and Jill O’Callahan are suing him as well, alleging that he has not paid them the estimated $315,000 revenue of the business partnership. Keese, Finnerty and O’Callahan disband the partnership and liquidate the assets, claiming Tom stole money from their businesses “for his own personal gain” and repaid business loans with no knowledge of his personal use.

Wells Fargo Suit
Additionally, the bank has filed a lawsuit against Tom as well as his Girardi Keese business, claiming that he failed to pay monthly for the cost of rent, taxes fees, and other charges in their office. According to documents that was obtained by Us the group has a debt to Wells Fargo $882,000. Wells Fargo is also seeking interest of 10 percent per year beginning from to the day of default, and would like to seize Girardi Keese’s Los Angeles and San Bernardino, California, properties.

Our sources told us the month of December Erika believes that Tom has cheated on her over the 21 years of their marriage. “Erika is struggling with the process. She’s very resilient but it’s been very difficult on her psychologically,” an insider told Us. Another source said that rumors suggesting that Erika as well as Tom “had an agreement in terms of being with other people” were not true. Tom hasn’t yet made a statement on the accusations of infidelity.

A source has told Us that Erika had no idea that Tom “could be capable of doing what he has been accused of in court.”
“Erika was completely unaware of the very serious allegations that were being made against Tom in court,” the source informed Us in reference to the allegations of fraud. “Tom always took care of all the financial matters and that’s the way they handled matters. Erika is feeling being betrayed by Tom since she completely believed in Tom. Erika is struggling to come to terms with all this, but don’t make any mistake. Erika is tough as nails and she’s not a fool. She’ll get through this.”
According to a different person who has a second source Erika remains being in “disbelief” about the alleged fraud and legal drama “The Legal issues surfacing in a series of events and she’s learning while everyone else is filing. While the entire world finds out the details, she’s learning about the scandal. She’s been reading of it on the media before she gets it from her lawyers.”
While she’s seemingly kept her innocence throughout every RHOBH filming, Jay Edelson, the lawyer who initiated the lawsuit in a class action against the two, said she knew about the plot.
“We believe we’re going to be able to prove that Erika was incredibly involved in not just the law firm, but also, he was loaning money to her company 10s of millions of dollars to her company,” Edelson revealed in his “Reality Life with Kate Casey” podcast in June 2021. “And we believe that the money was derived from client funds. We’ll be looking into this. This will be one of the things we presented to a jury that she was a participant in this scam, and she’ll be able to say, “Oh she didn’t even know about it. It’s a thought it’s going to be difficult to convince jurors.”
“This is Justice Tricia A. Bigelow. She was f–king my husband Tom Girardi and he was paying her Saks bill and paying for her plastic surgery,” Erika captioned an Instagram post on the 18th of December posting images of messages.
Justice Bigelow’s Response
The lawyer of the judge issued an open letter in The L.A. Times, saying Erika’s “actions in maliciously doxxing the Justice were nothing short of criminal.”
The attorney also said: “We are considering our options to protect Justice Bigelow from further harassment.”
Erika’s New Digs
According to court papers that were obtained through Us at the beginning of January in 2021 Erika has moved from her mansion worth $15 million with Tom and moved into a three-bedroom home situated in Los Angeles. The new house is estimated to cost around $2,408,937 or $9500 a month of rent, according to Zillow.
Return to Court
Tom appeared on video in court at the time of his appearance on 9 June 2021 telling the judge that that he “disagree[d]” with the conservatorship. “I think that we should put together the reasons why the conservatorship should be dissolved, and then we’ll address it, address the court,” Tom told the judge. “Right now, I have nothing to say to the court.”
The judge later determined that Robert would be Tom’s conservator.
