Man Charged With Felony After Failing To Pay For $1 Soda

Reuters reports that a man in Florida was charged with felony after failing to pay $1 for the soda he consumed in McDonald’s. Mark Abaire of Naples filled his cup with soda, but refused to pay, so the manager called the police to get the man arrested.

Mark Abaire is probably the only man to face felony over a glass of soda worth $1, yet it is true. The 52-year-old man entered the McDonald’s restaurant in Naples around 10 p.m. on Thursday. The manager told police officers that Abaire requested a glass of water. After receiving the recipient, the man took it to the fountain machine and filled it with soda, even though employees repeatedly told him it was for water, not for soda.

The man took the cup of water and sat outside the restaurant, ignoring the manager’s requests to pay for the cup of soda. Moreover, he started cursing the employees of the facility when they asked him to leave the premises, so they had to call the police. Based on the police report, Abaire was charged with petty theft, but given that he had many other petty convictions before, the charge was increased from misdemeanor to felony.

It is unclear what will happen to the man as he was retained in the Collier County jail on Saturday. His bond was set to $6,500, a huge sum of money considering that the man was not able to pay $1 for his soda. According to the rules of the Florida state, Mark Abaire might be imprisoned for a long period of time because third-degree felonies can result in a sentence of up to 5 years and a $5,000 fine.

The $1 soda theft is not the only charge that Abaire is facing at present. He was also accused of misdemeanor counts of trespassing and disorderly intoxication.
