Louboutin is denied right to sue YSL over red soles

Christian Louboutin will not be able to use the red soles exclusively, even though he presented them for the first time. A federal judge denied his right to sue YSL over using the red soles, motivating that it would be unlikely that Louboutin would be able to prove that its own ever-present red soles are suited for a trademark protection, Fox News reports.
 
Earlier this year, Christian Louboutin has filed a lawsuit against Yves Saint Laurent (YSL) in order to halt the production of the fashion house’s red sole shoes. He came up with strong arguments, explaining how some of the shoes in the Yves Saint Laurent collection feature soles in different shades of red and this entitles the Louboutin house to sue YSL. Louboutin has gained an award offered by the US Patent  and Trademark Office for his invention in 2008.

While the process was pending, Louboutin tried a preliminary injunction in order to prevent YSL from selling the shoes, but  Judge Victor Marreo did not see him winning the case, so, as a result, he denied the injunction.  He issued a 30-page ruling in which he gave YSL permission to sell as much red-sole shoes as the house wants and  more than that, he challenged the entire basis of Louboutin’s 2008 trademark. Marreo gave several reasons for which he denied a lawsuit to Louboutin.  “Louboutin’s claim would cast a red cloud over the whole industry, cramping what other designers could do, while allowing Louboutin to paint with a full palette”, one of his motivations was. So, the shade of red that Louboutin obtained sole trademark for (which, by the way, is the Pantone-18 Chinese Red shade) cannot be used only by him. “Whatever commercial purposes may support extending trademark protection to a single color for industrial goods do not easily fit the unique characteristics and needs — the creativity, aesthetics, taste, and seasonal change — that define production of articles of fashion”, the judge added.

Singers Nicki Minaj and Ricky Martin are the new faces of MAC’s Viva Glam campaign, taking the position of spokesperson from Lady Gaga, who held the position since the spring of last year, Us Magazine reports.

Rapper and songwriter Nicki Minaj joined sexy Latin singer Ricky Martin in the MAC Viva Glam campaign. The make-up company has chosen Minaj, 26, and Martin, 39, to be the representatives of the brand, according to a press release issued on Monday. And the music artists have already started their work. The blonde Victoria’s Secret Angel Candice Swanepoel is launching a new Victoria’s Secret fragrance named Sheer Love, CBS reports. The South African lingerie model adds one more scent to the Fantasies collection.

Actress Melissa McCarthy, whom you can see in “The Bridesmaids” has slimmed down for a photo shooting for GQ magazine. She practically lost the weight in a matter of moments when putting on a T-shirt with a picture of a national bikini swimsuit perfect toned slim body, the Daily Mail reports

The latest example is her character in the recent movie, the Bridesmaids. She plays Megan, an unattractive woman, the sister of the groom, who joins the group of bridesmaids. Eve though her character was criticized by Overeaters Anonymous for making fun of fat people, the creator of the movie, Chuck Lorre, who also created Two And A Half Men, said he never intended to make-up a story about Overeaters Anonymous. “It’s just a show about people with problems,” Lorre said,  “which I think is the reason I wanted to do a show like this, was to get real people back on TV, because problems are usually what comedy is built around.”

They change the water’s taste adding a fresh flavor.

3. Do good for you. In other words, take care of yourself, make this a priority. Frankel believes that “if you don’t take care of yourself, you can’t take care of anything else.” According to the “Real Housewives” star a good state of self is the basis on which you can build anything you wish.

Jennifer Hudson Promotes Healthy Lifestyle in Schools

This Tuesday, Jennifer Hudson was on a lifestyle mission in Chicago schools. After losing weight she became a spokesman for Weight Watchers and helps promoting a healthy living in schools.

A new Jennifer Hudson has taken the plea for helping America slim down.The “Idol” contestant and Oscar winner went herself through a weight loss program which helped her reshape her body an gain the confidence she otherwise was lacking. Now, she returned to her hometown and stopped to Namaste Charter School. The children gathered in the school’s gym where Hudson talked to them about a healthy way of living, healthy food and exercise. She even showed them a part of her workout and they all tried to do it together, including school Principal Allison Slade.

Hudson also talked to students about her new regimen and promoted the Weight Watchers Walk – It Challenge which will take place on May 22. The challenge is social event organized with the purpose of raising awareness towards the need for exercise. It encourages Americans to run or walk ( according to each person’s physical abilities ) for 5 km. Walking is a light activity that can be performed by anyone without having any negative effects. It is a natural activity of the body.

Jennifer Hudson, who is now 29 years old, lost 80 pounds with the Weight Watchers program and now credits it with her new body image. Photos reveal toned legs and arms and a bigger smile on her face. Hudson presented a check of 100,000 dollars to the Alliance for a Healthier Generation, which is a non-profit organization that works on a special plan of reducing childhood obesity rate by 2015.
